Real Estate Law 12th Edition by Marianne M. Jennings

Overview

Introduce the day-to-day transactions of today’s dynamic real estate marketplace as you bring the law of real estate ownership, transfer and development to life with Jennings's REAL ESTATE LAW, 12E. Extensive revisions reflect monumental changes in real estate law today with new cases, new laws and current trends. Students discover how vibrancy of the law affects property as they examine revolutionary changes in alternative energy sources from solar panels to wind towers or review litigation over whether fossil finds involve surface or mineral rights. Updates take a new look at CC&Rs, examine how Airbnbs have changed zoning laws and taxes and review the three layer of issues surrounding commercial leases.

This practical study discusses rules and regulations affecting real estate today as students examine the impact on business and how to adjust real estate transactions for legal changes. Both future and practicing real estate professionals learn to recognize, prevent, and resolve legal problems with this edition's unique approach.

  • SIGNIFICANT UPDATES REFLECT EXTENSIVE CHANGES IN REAL ESTATE LAW WHILE RETAINING THE BOOK'S PROVEN APPROACH. This edition illustrates immense changes to real estate law with new cases, laws, regulations and chapter content while preserving the book's popular, proven learning features. Expanded discussion explores developments such as how medical advancements have forced changes in laws regarding inheritances for children conceived after the death of the testator. Students also explore how law on eminent domain has shifted with yet another US Supreme Court decision.
  • NEW AND PROVEN ETHICAL ISSUES ENCOURAGE STUDENTS TO EVALUATE CONDUCT FOR FAIRNESS AND HONESTY. For example, students examine whether a person needs to own nearby land to bring a nuisance case against a hog-farm in North Carolina and whether it's ethical to shut down numerous family-owned hog farms. Another new ethical issue reviews commercial landlords' assessments of tenants for common areas. An ethical issue in Ch. 13 explains how house sellers claim to be selling to move closer to friends, but are actually selling because a sex offender lives next door.
  • TODAY’S MOST RECENT EXCERPTED CASES INTRODUCE THE LANGUAGE OF THE COURT. For clear presentation, case facts are summarized by the author, while opinions are presented in the language of the court. These cases pertain to many issues affecting today’s real estate market, including environmental issues, foreclosures, eminent domain, unmarried cohabitants and homeowners' associations. Many cases are from 2018-2020 with new cases in every chapter.
  • INNOVATIVE LEARNING FEATURES AND CLEAR APPROACH ENSURE UNDERSTANDING. Each chapter contains "Consider..." features that encourage students to refine their critical-thinking skills by applying the rule of law to a slightly different fact scenario. Additional "Practical Tip" sidebars highlight useful pointers for successfully practicing real estate law. Updated and new sidebars help students recall critical points from this edition's cases and reading.
